acquiring a holding — not only purchasing a holding, but also acquisition by any other means whatsoever, including acquisition in one of the situations referred to in Article 92 art_86__para
collective investment undertakings other than the closed-end type — unit trusts and investment companies:
the object of which is the collective investment of capital provided by the public, and which operate on the principle of risk spreading, and
the units of which are, at the holders' request, repurchased or redeemed, directly or indirectly, out of the assets of these undertakings. Action taken by such undertakings to ensure that the stock exchange value of its units does not significantly vary from their net asset value shall be regarded as equivalent to such repurchase or redemption (b)
controlled undertaking — any undertaking in which a natural person or legal entity:
has a majority of the shareholders' or members' voting rights; or
has the right to appoint or remove a majority of the members of the administrative, management or supervisory body and is at the same time a shareholder in, or member of, the undertaking in question; or
is a shareholder or member and alone controls a majority of the shareholders' or members' voting rights pursuant to an agreement entered into with other shareholders or members of the undertaking 1.
credit institution — an undertaking whose business is to receive deposits or other repayable funds from the public and to grant credits for its own account (d)
investment companies other than those of the closed-end type — investment companies:
