appropriate agency — — in relation to a shellfish water protected area that is wholly in England, the Agency; in relation to a shellfish water protected area that is wholly in Wales, NRW Section 9(8)
appropriate authority — — in relation to a shellfish water protected area or proposed area that is wholly in England, the Secretary of State; in relation to a shellfish water protected area or proposed area that is wholly in Wales, the Welsh Ministers Section 9(8)
appropriate nature conservation bodies — the Joint Nature Conservation Committee, and— in relation to a river basin district that is wholly in England, Natural England; in relation to a river basin district that is partly in England and partly in Wales, Natural England in relation to the part in England; “harbour” and “harbour authority” have the meanings given by section 57 of the Harbours Act 1964 Section 29(5)
aquifer — a subsurface layer or layers of rock or other geological strata of sufficient porosity and permeability to allow either a significant flow of groundwater or the abstraction of significant quantities of groundwater Schedule 1, paragraph 1(2)
artificial or heavily modified water body — a body of surface water designated as such under regulation 15 Section 2(1)
body of groundwater — a distinct volume of groundwater within an aquifer or aquifers Schedule 1, paragraph 1(2)
body of surface water — a discrete and significant element of surface water such as a lake, a reservoir, a stream, river or canal, part of a stream, river or canal, a transitional water or a stretch of coastal water Schedule 1, paragraph 1(2)
body of water — a body of groundwater or a body of surface water; “drinking water protected area” has the meaning given by regulation 8; “England” includes the territorial sea adjacent to England not forming any part of Wales; “environmental objectives”, in relation to a river basin district or body of water, means the objectives set under regulation 12 in accordance with regulation 13 Section 2(1)
coastal water — surface water on the landward side of a line, every point of which is at a distance of one nautical mile on the seaward side from the nearest point of the baseline from which the breadth of territorial waters is measured, extending where appropriate up to the outer limit of transitional waters Schedule 1, paragraph 1(2)
determine an authorisation — decide whether to grant, vary or revoke, or impose conditions (and if so which conditions) on— an environmental permit under the Environmental Permitting (England and Wales) Regulations 2016 ; a licence for an abstraction or impoundment under Chapter 2 of Part 2 of the Water Resources Act 1991 Section 3(3)
direct discharges of pollutants into groundwater — the discharge of pollutants into groundwater without percolation through the soil or subsoil; “ecological status” is an expression of the quality of the structure and functioning of aquatic ecosystems associated with surface waters, classified in accordance with Annex V and such Directions as the appropriate authority may give to the appropriate agency Schedule 1, paragraph 1(2)
good ecological potential — the status of an artificial or heavily modified water body classified as such in accordance with the relevant provisions of Annex V and such Directions as the appropriate authority may give to the appropriate agency Schedule 1, paragraph 1(2)
good ecological status — the status of a body of surface water classified as such in accordance with the relevant provisions of Annex V and such Directions as the appropriate authority may give to the appropriate agency Schedule 1, paragraph 1(2)
good groundwater chemical status — the chemical status of a body of groundwater which meets all the conditions set out in table 2.3.2 of Annex V Schedule 1, paragraph 1(2)
good groundwater status — the status of a body of groundwater when both its chemical and quantitative status are at least good Schedule 1, paragraph 1(2)
good surface water chemical status — the chemical status required to meet the environmental objectives for surface waters under regulation 13(2), that is the chemical status achieved by a body of surface water in which concentrations of pollutants do not exceed the environmental quality standards established by the table of priority substances, and under relevant assimilated law which sets environmental quality standards Schedule 1, paragraph 1(2)
groundwater — all water which is below the surface of the ground in the saturation zone and in direct contact with the ground or subsoil; “groundwater status” is the general expression of the status of a body of groundwater, determined by the poorer of its quantitative status and chemical status Schedule 1, paragraph 1(2)
hazardous substances — substances or groups of substances that are toxic, persistent and liable to bio-accumulate, and other groups of substances which give rise to an equivalent level of concern Schedule 1, paragraph 1(2)
inland water — all standing and flowing water on the surface of the land, and all groundwater on the landward side of the baseline from which the breadth of the territorial sea is measured Schedule 1, paragraph 1(2)
inshore fisheries and conservation authority — the inshore fisheries and conservation authority for an inshore fisheries and conservation district Section 29(5)
inshore fisheries and conservation district — an inshore fisheries and conservation district established by an order under section 149(1) of the Marine and Coastal Access Act 2009 Section 29(5)
lake — a body of standing inland surface water Schedule 1, paragraph 1(2)
local authority — the council of any county, county borough, district or London borough, the Common Council of the City of London or the Greater London Authority; “local planning authority” has the meaning given by section 1 of the Town and Country Planning Act 1990 ; “navigation authority” has the meaning given by section 221(1) of the Water Resources Act 1991 ; “the relevant date”, in relation to a plan, means— if a period of time has been directed under regulation 27(1)(a), the date on which that period begins, or otherwise, the date by which the appropriate authority is next required under regulation 31(5) to publish an updated plan Section 29(5)
NRW — the Natural Resources Body for Wales; “programme of measures”, in relation to a river basin district, means the programme of measures established under regulation 12 in accordance with regulation 20 Section 2(1)
pollutant — any substance liable to cause pollution, including those listed in Annex VIII Schedule 1, paragraph 1(2)
pollution — the direct or indirect introduction, as a result of human activity, of substances or heat into the air, water or land which may be harmful to human health or the quality of aquatic ecosystems or terrestrial ecosystems directly depending on aquatic ecosystems, which result in damage to material property, or which impair or interfere with amenities and other legitimate uses of the environment; “priority substance” and Schedule 1, paragraph 1(2)
priority hazardous substance — a substance identified as such in Annex X to the WFD; “quantitative status” is an expression of the degree to which a body of groundwater is affected by direct and indirect abstractions Schedule 1, paragraph 1(2)
protected area — an area included on a register in accordance with regulation 10; “public body” does not include a Minister of the Crown within the meaning of the Ministers of the Crown Act 1975 , the Welsh Ministers, the First Minister for Wales or the Counsel General to the Welsh Government, but does include— a person otherwise holding an office— under the Crown, created or continued in existence by a public general Act of Parliament, or the remuneration in respect of which is paid out of money provided by Parliament; a statutory undertaker, being a person who by virtue of section 262 of the Town and Country Planning Act 1990 is, or is deemed to be, a statutory undertaker for any purpose Section 2(1)
relevant functions — functions under these Regulations and, so far as material, the enactments listed in Parts 1 and 2 of Schedule 2 (which relate to statutes and subordinate legislation) Section 2(1)
river — a body of inland water flowing for the most part on the surface of the land but which may flow underground for part of its course Schedule 1, paragraph 1(2)
river basin — the area of land from which all surface run-off flows through a sequence of streams, rivers and, possibly, lakes into the sea at a single river mouth, estuary or delta Schedule 1, paragraph 1(2)
river basin district — an area identified by regulation 4(1), being the main unit for the management of river basins for the purposes of the WFD and being made up of a river basin or neighbouring river basins, together with associated groundwater, transitional waters and coastal water Section 2(1)
river basin management plan — a plan to which Part 6 applies Section 2(1)
shellfish — any bivalve or gastropod mollusc; “shellfish water protected area” has the meaning given by regulation 9; “status”, in relation to a body of water, is a reference to its surface water status or groundwater status (as the case may be) Section 2(1)
surface water — inland waters, except groundwater; transitional waters and coastal waters except in respect of chemical status for which it shall also include territorial waters Schedule 1, paragraph 1(2)
surface water status — the status of a body of surface water, determined by the poorer of its ecological status and chemical status Schedule 1, paragraph 1(2)
the 2003 Regulations — the Water Environment (Water Framework Directive) (England and Wales) Regulations 2003 Section 2(1)
the Agency — the Environment Agency; “the appropriate agency”, except as provided for by regulation 9(8), means— in relation to a river basin district that is wholly in England, the Agency; in relation to a river basin district that is wholly in Wales, NRW; in relation to a river basin district that is partly in England and partly in Wales, the Agency and NRW acting jointly; “the appropriate authority”, except as provided for by regulation 9(8), means— in relation to a river basin district that is wholly in England, the Secretary of State; in relation to a river basin district that is wholly in Wales, the Welsh Ministers; in relation to a river basin district that is partly in England and partly in Wales, the Secretary of State and the Welsh Ministers acting jointly Section 2(1)
the EQSD — Directive 2008/105/EC of the European Parliament and of the Council on environmental quality standards in the field of water policy Section 2(1)
the GWD — Directive 2006/118/EEC of the European Parliament and of the Council on the protection of groundwater against pollution and deterioration Section 2(1)
the official map — the map of river basin districts produced by the Agency and published on its website Section 4(2)
the table of priority substances — the table in Part A of Annex I to the EQSD; “Wales” has the meaning given by section 158 of the Government of Wales Act 2006 ; “water intended for human consumption” has the same meaning as in Council Directive 98/83/EC on the quality of water intended for human consumption Section 2(1)
the WFD — Directive 2000/60/EC of the European Parliament and of the Council establishing a framework for Community action in the field of water policy Section 2(1)
transitional waters — bodies of surface water in the vicinity of river mouths which are partly saline in character as a result of their proximity to coastal waters but which are substantially influenced by freshwater flow Schedule 1, paragraph 1(2)
water services — all services which provide, for households, public institutions or any economic activity— abstraction, impoundment, storage, treatment and distribution of surface water or groundwater; waste-water collection and treatment facilities which subsequently discharge into surface water Schedule 1, paragraph 1(2)
water use — water services together with any other activity identified as having a significant impact on the status of water in the analyses carried out under regulations 5 and 7 in accordance with Annex II Schedule 1, paragraph 1(2)
