Article 15

Powers Subject to review of its decision by the Court of Justice, the Commission shall have sole power: - to impose obligations pursuant to Article 4 (2); to issue decisions pursuant to Article 5 and 6. The authorities of the Member States shall retain the power to decide whether any case falls within the provisions of Article 2 or Article 8, until such time as the Commission has initiated a procedure with a view to formulating a decision in the case in question or has sent notification as provided for in the first subparagraph of Article 12 (3).
