Article 49

Where the provisions of this Chapter are not observed and a formal notice addressed to the person concerned has been ineffectual, the competent authorities of the Member States may suspend or withdraw marketing authorization. All decisions taken by virtue of the preceding paragraph shall state in detail the reasons on which they are based. A decision shall be notified to the party concerned, along with the remedies available to him under current legislation and the time allowed for seeking such remedies.
