( 2 ) Unbeschadet des Absatzes 1 brauchen die Mitgliedstaaten diese Richtlinie nicht auf Kreditinstitute anzuwenden, die in Artikel 2 Absatz 2 der Richtlinie 77/780/EWG aufgeführt sind .
