Article 9

Council Directive 90/531/EEC of 17 September 1990 on the procurement procedures of entities operating in the water, energy, transport and telecommunications sectors · European Union

1. This Directive shall not apply to: (a)contracts which the contracting entities listed in Annex I award for the purchase of water; (b)contracts which the contracting entities specified in Annexes II, III, IV and V award for the supply of energy or of fuels for the production of energy. 2. The Council shall re-examine the provisions of paragraph 1 when it has before it a report from the Commission together with appropriate proposals.
