The Commission shall, in accordance with the procedure laid down in Article 21, determine: the conditions under which the above concentration levels will not apply to recycled materials and to product loops which are in a closed and controlled chain, the types of packaging which are exempted from the requirement referred to in paragraph 1, third indent.
