Article 3 › 1b

Member States shall provide that the undertakings referred to in point (c) of Article 1(3) guarantee posted workers the terms and conditions of employment which apply pursuant to Article 5 of Directive 2008/104/EC of the European Parliament and of the Council ( 2 ) to temporary agency workers hired-out by temporary-work agencies established in the Member State where the work is carried out.
