(b)

in the case of import into, or transit through, the Community of waste that does not originate in a Member State, any of the following natural or legal persons under the jurisdiction of the country of destination who intends to carry out a shipment of waste or intends to have, or who has had, a shipment of waste carried out, being either: the person designated by the law of the country of destination; or, in the absence of any such designation, the holder at the time the export took place;
