which, in relation to shipments of waste as referred to in Article 3(2) and (4), has resulted from: the waste being discovered not to be listed in Annexes III, IIIA or IIIB, or non-compliance with Article 3(4), the shipment being effected in a way which is not specified materially in the document set out in Annex VII.
