However, if a vehicle defined as BA, BB with a technically permissible maximum mass exceeding 3 500 kg, BC or BD meets at least one of the following conditions: this vehicle is not considered to be a vehicle of category N. See Part C, item of this Annex for the definitions of ‘seating positions’, P, M and N. the number of seating positions, excluding the driver, is more than 8 or P – (M + N × 68) ≤ N × 68
