A video-sharing platform provider which is not established on the territory of a Member State pursuant to paragraph 1 shall be deemed to be established on the territory of a Member State for the purposes of this Directive if that video-sharing platform provider: has a parent undertaking or a subsidiary undertaking that is established on the territory of that Member State; or is part of a group and another undertaking of that group is established on the territory of that Member State.
