Article 108(5) is amended as follows: point (b) of the first subparagraph is replaced by the following: ‘(b) if necessary, refer the matter to ESMA, which may act in accordance with the powers conferred on it under Article 19 of Regulation (EU) No 1095/2010.’; the second subparagraph is replaced by the following: ‘The Commission and ESMA shall be informed without delay of any measure taken pursuant to point (a) of the first subparagraph.’.
