‘control’ means the same as in Article 3(2) and (3) of Council Regulation No 139/2004 OJ L 24, 29.1.2004, p. 1. as applied in the Commission’s Consolidated Jurisdictional Notice OJ C 95, 16.4.2008, p. 1. . Recital (22) of that Regulation and paragraphs 52 and 53 of that Notice shall apply for determining the notion of control for state-owned undertakings;
