In negotiated procedures and after a competitive dialogue, the number of candidates invited to negotiate or to tender may not be less than three, provided that a sufficient number of candidates satisfy the selection criteria. The number of candidates invited to tender must be sufficient to ensure genuine competition. The first and second subparagraphs shall not apply to the following: contracts involving very low values, as referred to in Article 137(2); contracts for legal services according to the CPV nomenclature; contracts declared secret, as referred to in Article 134(1)(j).
