2.

The approval authority shall grant the EU type-approval referred to in paragraph 1 where all of the following conditions are met: the application states the reasons why the technologies or concepts in question make the system, component or separate technical unit incompatible with one or more acts listed in Annex I; the application describes the safety and environmental implications of the new technology and the measures taken in order to ensure at least an equivalent level of safety and environmental protection as that provided by the requirements from which exemption is sought; test descriptions and results are presented which prove that the condition in point (b) is met.
