Where an institution is either of the following, it shall include the commodities concerned in the calculation of its own funds requirement for commodities risk: (a) the transferor of commodities or guaranteed rights relating to title to commodities in a repurchase agreement; (b) the lender of commodities in a commodities lending agreement.
