Article 388 — Negative Scope

This Part shall not apply to investment firms that fulfil the criteria set out in Article 95(1) or Article 96(1). This Part shall not apply to a group on the basis of its consolidated situation, if that group only includes investment firms referred to in Article 95(1) or Article 96(1) and ancillary companies and where that group does not include credit institutions.
