DIRECTIVE 2014/23/EU OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL of 26 February 2014 on the award of concession contracts (Text with EEA relevance) · European Union

Article 2d is amended as follows: in paragraph 1, point (a) is replaced by the following: if the contracting entity has awarded a contract without prior publication of a notice in the Official Journal of the European Union without this being permissible in accordance with Directive 2014/25/EU or Directive 2014/23/EU’; in point (b), the words ‘Directive 2004/17/EC’ are replaced by the words ‘Directive 2014/25/EU or Directive 2014/23/EU’; in paragraph 4, the first indent is replaced by the following: ‘— the contracting entity considers that the award of a contract without prior publication of a notice in the Official Journal of the European Union is permissible in accordance with Directive 2014/25/EU or Directive 2014/23/EU,’; in paragraph 5, the first indent is replaced by the following: ‘— the contracting entity considers that the award of a contract is in accordance with Article 52(6) of Directive 2014/25/EU,’;
