MiFID II

DIRECTIVE 2014/65/EU OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL of 15 May 2014 on markets in financial instruments and amending Directive 2002/92/EC and Directive 2011/61/EU (recast) (Text with EEA relevance) · European Union

The Commission shall be empowered to adopt delegated acts in accordance with Article 89 to specify: (a) the procedures for requesting treatment as clients under paragraph 2; (b) the procedures for obtaining the express confirmation from prospective counterparties under paragraph 3; (c) the pre-determined proportionate requirements, including quantitative thresholds that would allow an undertaking to be considered to be an eligible counterparty under paragraph 3.
