Article 34 — Persons entitled to bring an action for infringement

DIRECTIVE (EU) 2015/2436 OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL of 16 December 2015 to approximate the laws of the Member States relating to trade marks (Recast) (Text with EEA relevance) · European Union

1. Article 25(3) and (4) shall apply to every person who has the authority to use a collective mark. 2. The proprietor of a collective mark shall be entitled to claim compensation on behalf of persons who have authority to use the mark where those persons have sustained damage as a result of unauthorised use of the mark.
