The Commission shall be empowered to adopt delegated acts in accordance with Article 264 concerning derogations from the movement or release requirements laid down in paragraphs 1 and 2 of this Article which do not pose a significant risk for the spread of listed diseases as referred to in point (d) of Article 9(1) on account of: the species, categories, and life stage of the aquaculture animals concerned; the type of establishment of origin and of destination; the intended use of the aquaculture animals; the place of destination of the aquaculture animals; treatments, processing methods and other special risk-mitigation measures applied at the place of origin or destination.
