The Commission may, on request or on its own initiative, reopen proceedings relating to an exemption request where: taking due account of the legitimate expectations of the parties and of the economic balance achieved in the original exemption decision, there has been a material change in any of the facts on which the decision was based; the undertakings concerned act contrary to their commitments; or the decision was based on incomplete, incorrect or misleading information, which was provided by the parties.
