Regulation (EU) 2019/943 of the European Parliament and of the Council of 5 June 2019 on the internal market for electricity (recast) (Text with EEA relevance.) · European Union

The decision referred to in paragraph 4 shall be taken by ACER: where the regulatory authorities concerned have not been able to reach an agreement within six months from the date on which the last of those regulatory authorities received the exemption request; or upon a joint request from the regulatory authorities concerned. Before taking such a decision, ACER shall consult the regulatory authorities concerned and the applicants.
