Derogations granted by Member States in accordance with Article 9(1) of Directive 98/83/EC that are still applicable on 12 January 2023 shall remain applicable until the end of their duration. They may be renewed in accordance with Article 15 of this Directive only where a second derogation has not yet been granted. The right to ask the Commission for a third derogation in accordance with Article 9(2) of Directive 98/83/EC shall remain applicable for second derogations that are still applicable on 12 January 2021.
