REGULATION (EU) 2022/1925 OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL of 14 September 2022 on contestable and fair markets in the digital sector and amending Directives (EU) 2019/1937 and (EU) 2020/1828 (Digital Markets Act) (Text with EEA relevance) · European Union

1. The Commission shall adopt an implementing act setting out its finding of non-compliance (‘the non-compliance decision’) where it finds that a gatekeeper does not comply with one or more of the following: any of the obligations laid down in Article 5, 6 or 7; measures specified by the Commission in a decision adopted pursuant to Article 8(2); remedies imposed pursuant to Article 18(1); interim measures ordered pursuant to Article 24; or commitments made legally binding pursuant to Article 25. That implementing act shall be adopted in accordance with the advisory procedure referred to in Article 50(2).
