(76) The applicable Union framework should give consumers the confidence that creditors and credit intermediaries take account of the interests of the consumer, including their possible vulnerability and difficulties in understanding the product, based on the information available to the creditor or the credit intermediary at the relevant time and on reasonable assumptions about risks to the consumer’s situation over the term of the proposed credit agreement. A key aspect of ensuring such consumer confidence is the requirement to ensure a high degree of fairness, honesty and professionalism in the industry, which also includes responsible behaviour to avoid practices that have a negative impact on consumers, and appropriate management of conflicts of interest including those arising from remuneration, as well as to give advice in the best interests of the consumer.
