4. Where a joint application is submitted in accordance with Article 8(5), the application to the Office shall be submitted by: the competent authority of one of the Member States concerned, where the cross-border geographical area is located in more than one Member State; the competent authority of the Member State concerned, where the cross-border geographical area is located in both a Member State and a third country; the third-country applicant, or by the competent authority of one of the third countries concerned, where the cross-border geographical area is located in more than one third country.
