Article 2 — Definitions

1. The terms used in this Directive for the purpose of describing conduct listed in Article 3(2) shall be construed, where applicable, in accordance with definitions provided for in Union law as referred to in Article 3(1), point (a). 2. For the purposes of this Directive, the following definitions apply: (a) ‘legal person’ means any legal entity having such status under the applicable national law, except for States or public bodies exercising State authority and for public international organisations; (b) ‘habitat within a protected site’ means any habitat of species for which an area is classified as a special protection area pursuant to Article 4(1) or (2) of Directive 2009/147/EC, or any natural habitat or habitat of species for which a site is designated as a special area of conservation in accordance with Article 4(4) of Directive 92/43/EEC or for which a site is listed as a site of Community importance in accordance with Article 4(2) of Directive 92/43/EEC; (c) ‘ecosystem’ means a dynamic complex of plant, animal, fungi and microorganism communities and their non-living environment, interacting as a functional unit, and includes habitat types, habitats of species and species populations.
