the following paragraphs are added: ‘7. EBA shall develop draft regulatory technical standards to further specify the elements that are to be taken into consideration by the competent authority when deciding whether to grant a waiver in accordance with paragraph 3a, taking into account, in particular, the materiality of the counterparty credit risk to which an undertaking is exposed. EBA shall submit those draft regulatory technical standards to the Commission by 10 January 2026. Power is delegated to the Commission to supplement this Directive by adopting the regulatory technical standards referred to in the first subparagraph of this paragraph in accordance with Articles 10 to 14 of Regulation (EU) No 1093/2010. 8. By 31 December 2028, EBA shall submit a report to the Commission on the use of the waiver as referred to in paragraph 3a of this Article as well as on the application of Article 4(1), point (1)(b)(iii), of Regulation (EU) No 575/2013.’ ;
