12. EIOPA shall develop draft regulatory technical standards to specify further: the criteria, in particular as regards cross-border activity, referred to in paragraph 2, first subparagraph; the methods to be used when determining the market shares referred to in paragraph 2, second and third subparagraphs; the information that an insurance or reinsurance undertaking is to include in the pre-emptive recovery plan, including the remedial actions referred to in paragraph 6, point (e), and their implementation. EIOPA shall submit those draft regulatory technical standards to the Commission by 29 July 2026. Power is delegated to the Commission to supplement this Directive by adopting the regulatory technical standards referred to in the first subparagraph in accordance with Articles 10 to 14 of Regulation (EU) No 1094/2010.
