The critical EQS is the biota EQS (relating to fish consumption) and must therefore be complied with. The AA-EQS are not equivalently protective. (28) “Pesticides” means plant protection products as referred to in Article 2 of Regulation (EC) No 1107/2009 and biocidal products as defined in Article 3 of Regulation (EU) No 528/2012.
