Article 31

Regulation (EU) 2026/1738 of the European Parliament and of the Council of 8 July 2026 on circularity requirements for vehicle design and on management of end-of-life vehicles, amending Regulations (EU) No 168/2013, (EU) 2018/858, (EU) 2019/1020 and (EU) 2023/1542 and repealing Directives 2000/53/EC and 2005/64/EC (Text with EEA relevance) · European Union

1. From 1 September 2029, any economic operator selling used, remanufactured or refurbished spare parts and components shall ensure that parts and components contain the labelling placed by authorised treatment facilities in accordance with Article 30(2), point (a). 2. In the case of sale of used, remanufactured or refurbished parts and components to consumers, the economic operators shall ensure that those parts and components are able to maintain their required functions and performance through normal use and comply with other requirements applicable to the goods sold in accordance with Directive (EU) 2019/771. 3. The requirements on economic operators in paragraphs 1 and 2 shall apply irrespective of the trading technique used, including online sales.
