paragraph 5g is replaced by the following: ‘5g. By way of derogation from paragraphs 1 and 2, the competent authorities may authorise, under such conditions as they deem appropriate, the export and transfer of the goods falling under CN codes 8517 62 and 8523 52, as listed in Annex XXIII, provided that they are intended for civilian electronic communications networks which are not the property of an entity that is publicly controlled or with over 50 % public ownership.’ ;
