in Article 3nb, the following paragraph is added: ‘5. By way of derogation from paragraph 1, the competent authorities of the Member States may authorise, under such conditions as they deem appropriate, the temporary storage, and the placement under the free-zone procedure pursuant to Article 245(3) of Regulation (EU) No 952/2013, of crude oil or petroleum products listed in Annex XXV to this Regulation in Union territory, if the goods originate in or are exported from Russia, after having established that: ; the goods concerned have been seized or confiscated by an authority of a Member State in the course of national administrative or judicial proceedings; the goods concerned remain under the effective control of the authorities of a Member State or of an entity acting on behalf of those authorities.’
