(14) See Recital 43 Damages Directive. In the situation of a buyers' cartel, the lower price paid by the infringers can be referred to as ‘undercharge’ and there could also be related upstream volume effects. However, it should be noted that suppliers can also be adversely affected in the situation of a seller's cartel. This can be the case if they supply less to the infringers because of the volume effect, i.e. a loss of profit due to the reduction in demand at the direct or even indirect purchaser level down the supply chain. The reduction in demand in relation to the cartelised input may also cause a reduction in demand of other inputs. The suppliers of such other inputs may also claim damages, provided they can show a causal link between their harm and the infringement of EU competition law.
