(20) In other words, these guidelines are without prejudice to the consideration of passing-on under national law, provided such law complies with the principle of equivalence and effectiveness, see paragraph 6 above. When they refer to passing-on as a reduction of the actual loss, this includes a consideration of passing-on by reference to other rules and principles, such as compensatio lucri cum damno.
