This ruling concerns Directive 1999/44/EC (OJ L 171, 7.7.1999, p. 12), but applies mutatis mutandis to the UCTD. Furthermore, in order to establish whether the terms in question falls within the scope of the UCTD, courts inevitably have to investigate whether there is a contract between a seller or supplier or a consumer.
