The UCTD neither defines the term ‘supplementary provision of national law’ nor uses it. In a different context, it refers to ‘rules which, according to the law, shall apply between the contracting parties provided that no other arrangements have been established’. This quasi-definition reflects what is generally understood to be the function of supplementary provisions, and, when using this term in connection with Article 6(1), the Court indeed refers to Recital 13 of the UCTD (316).
