| 126. | The definition of ‘damage to protected species and natural habitats’ provides for exclusions by reference to Articles 6(3) and (4) and 16 of the Habitats Directive and Article 9 of the Birds Directive. In Case C-297/19, Naturschutzbund Deutschland — Landesverband Schleswig-Holstein, the Court held that these exclusions must be interpreted strictly (135).
