COMMISSION NOTICE Guidelines providing a common understanding of the term ‘environmental damage’ as defined in Article 2 of Directive 2004/35/EC of the European Parliament and of the Council on environmental liability with regard to the prevention and remedying of environmental damage · European Union

| 142. | In contrast to damage to protected species and natural habitats, it follows from Article 3(1)(a) that the Environmental Liability Directive only applies to water damage caused by any of the occupational activities described in Annex III. Several of these occupational activities, such as abstraction and impoundment (149), and the discharge or injection of pollutants (150), are especially relevant to water. Several are regulated under the Water Framework Directive.
