COMMISSION NOTICE Guidelines providing a common understanding of the term ‘environmental damage’ as defined in Article 2 of Directive 2004/35/EC of the European Parliament and of the Council on environmental liability with regard to the prevention and remedying of environmental damage · European Union

| 26. | The Directive allows Member States to maintain or adopt more stringent provisions in relation to environmental damage (59). This is in line with Article 193 of the Treaty on the Functioning of the European Union (TFEU). However, the entitlement to have more stringent provisions is not the same as an entitlement to have different provisions which do not fulfil the Directive’s requirements; nor is it an entitlement to set aside the liability of operators for ‘environmental damage’ under the Directive. The requirements of the Directive must, as a minimum, be fulfilled in all respects.
