COMMISSION NOTICE Guidelines providing a common understanding of the term ‘environmental damage’ as defined in Article 2 of Directive 2004/35/EC of the European Parliament and of the Council on environmental liability with regard to the prevention and remedying of environmental damage · European Union

| 33. | Recital 15 of the Directive indicates that public authorities should ensure the proper implementation and enforcement of the scheme provided for by the Directive, and the Directive contains provisions according to which the competent authorities may require more information and an increased level of engagement from the operator (65). It is nevertheless important that competent authorities have recourse to sources of information other than that provided by the operator under the Directive.
