In C-922/19 Stichting Waternet (14) , the Court dealt with the question whether the continued supply of water to a dwelling in the case of change of occupancy without the new occupant’s express request constitutes ‘inertia selling’ in the meaning of point 29 of the UCPD Annex I (‘blacklist’), resulting in a right for the consumer not to pay for such supply in accordance with Article 27 of the CRD. The case required, inter alia, a determination whether a contract may be regarded as concluded between a water supply company and a consumer, in the absence of that consumer’s express consent.
