d1e4176-1-1__para__2
Workers with a fixed place of work are able to determine the distance between their home and workplace and can use and organise their time freely on the way to and from that workplace to pursue their own interests. The situation is therefore different from that of the Tyco case, in which the Court considered that workers, who did not have a fixed place of work, had lost this ability to freely determine the distance between their homes and the usual place of the start and finish of their working day (168).
