(375) Judgment in case C-484/04, Commission v United Kingdom, para. 20; Judgment in case C-428/09, Union syndicale Solidaires Isère, para. 41. While the Court remained silent on the precise elements leading to this interpretation, the Opinion of Advocate-General Kokott in the same case analysed the wording, context as well as objectives of the Directive in order to reach the conclusion that the derogation cannot apply to cases in which only part of the working time is not measured, predetermined or can be determined by the workers themselves. See case C-484/04, Opinion of Advocate General Kokott, 9 March 2006, Commission of the European Communities v United Kingdom of Great Britain and Northern Ireland, ECLI:EU:C:2006:166, paras. 22-32.
