COMMUNICATION FROM THE COMMISSION Interpretative Communication on Directive 2003/88/EC of the European Parliament and of the Council concerning certain aspects of the organisation of working time · European Union

Workers on maternity leave, who are, as a result, unable to work, must be guaranteed a right to paid annual leave and cannot be made subject to a condition to have actually worked. When absent on maternity leave during the reference period for paid annual leave they are to be treated in the same way as workers who have actually worked (317).
