As a consequence, exclusion from the scope set out in Article 2(2) of Directive 89/391/EEC must be interpreted restrictively (53) and ‘in such a way that its ambit is confined to what is strictly necessary in order to safeguard the interests which it enables the Member States to protect’ (54).
