COMMUNICATION FROM THE COMMISSION Interpretative Communication on Directive 2003/88/EC of the European Parliament and of the Council concerning certain aspects of the organisation of working time · European Union

The Court has held that Article 5 does not specify when the minimum weekly rest period must take place and that it gives Member States a degree of flexibility with regard to the choice on timing. The rest period may be provided at any time within each seven-day period (190). The Directive does not require the weekly rest to be granted on the same day of the week in each period of seven days.
