§2 A period of rest for each 7-day period (‘weekly rest’)

Article 5 establishes that workers must be entitled to a weekly rest period ‘per each seven-day period’. In light of the objective to protect the health and safety of workers, the Directive requires certain regularity of the weekly rest to which the worker is entitled. The Court has held that Article 5 does not specify when the minimum weekly rest period must take place and that it gives Member States a degree of flexibility with regard to the choice on timing. The rest period may be provided at any time within each seven-day period (190). The Directive does not require the weekly rest to be granted on the same day of the week in each period of seven days.
